March 3rd, 2009 Senator Alex Padilla (D – Pacoima) has introduced Senate Bill 600
Senator Alex Padilla (D – Pacoima) has introduced Senate Bill 600, which would increase the state tobacco tax by $1.50 per pack with equivalent increases for other tobacco products (cigars, smokeless tobacco, etc.). While bills to increase the tobacco tax have been introduced in several legislative sessions in a row (including one already introduced in the 2009 session, AB 89), this legislation by Senator Padilla is significant for three reasons:
1. SB 600 is sponsored by the American Lung Association of California, the American Cancer Society and the American Heart Association
2. This bill contains new funding dedicated to tobacco control/prevention
3. The leader of the Senate, President Pro Tempore Darrell Steinberg (D – Sacramento), is a coauthor of SB 600
SB 600 would allocate 85% of the revenues from the new tobacco tax to the General Fund for the state of California. The remaining 15% of revenues would be earmarked for tobacco control/prevention and lung cancer as follows: (1) 65% to the Department of Public Health, Tobacco Control Program to fund tobacco control programs including local health departments, competitive grants and media; (2) 15% to the Department of Education for programs to prevent or reduce tobacco use; (3) 10% to the University of California for tobacco related research; and (4) 10% to the University of California for the establishment and administration of a Lung Cancer Early Detection and Treatment Research Program. Finally, this bill would also include backfills (transferring funds to programs to replace revenues lost because of a reduction in tobacco sales due to this new tobacco tax increase) to other existing tobacco tax funded programs such as Prop 10, the non-tobacco control related Prop 99 accounts and the breast cancer fund. As currently written, there is a technical problem with the language in SB 600 that will need to be amended. The bill states that the tax increase would be $.0075 per cigarette, which would total a $.15 tax increase, when it should state $.075 per cigarette to get a $1.50 tax increase.
A full summary of SB 600 will be included in a Legislative Update from the Center later this week that will also include summaries of all new tobacco related bills introduced by the Friday, February 27 deadline for introducing new bills. These bills include several bills related to the state tobacco retailer license also introduced by Senator Padilla and bills related to restricting smoking at state parks, state beaches and hospitals.
